Terms of Service

These Terms of Service ("Terms") govern your access to and use of the cloud hosting services ("Services") provided by Jas InTech LLC ("JasCloud," "we," "us," or "our"), a California limited liability company. By creating an account or using our Services, you agree to be bound by these Terms.

1. Definitions

"Services" means the cloud infrastructure services offered by JasCloud, including virtual dedicated servers (VDS), GPU-accelerated instances, managed storage, networking, and related APIs.

"Customer," "you," or "your" refers to the individual or entity that has registered for an account.

"Content" means any data, software, applications, or materials you upload, store, transmit, or process through the Services.

2. Account Registration and Security

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately at support@jas.vc of any unauthorized use.

You must be at least 18 years old. If using Services on behalf of an organization, you represent authority to bind that organization.

3. Service Level Agreement (SLA)

JasCloud commits to 99.9% monthly uptime for production infrastructure. Service credits for failures:

  • 99.0%–99.9%: 10% credit of monthly fees
  • 95.0%–99.0%: 25% credit of monthly fees
  • Below 95.0%: 50% credit of monthly fees

Credits must be requested within 30 days. Excludes scheduled maintenance (48h notice), force majeure, and customer-caused issues.

4. Acceptable Use Policy

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Transmit unlawful, harmful, or defamatory content
  • Distribute malware or conduct phishing attacks
  • Send unsolicited bulk email (spam)
  • Engage in cryptocurrency mining without prior written approval
  • Perform unauthorized network scanning or penetration testing
  • Host content that infringes intellectual property rights
  • Operate illegal gambling or unauthorized financial services
  • Circumvent resource limits or quotas
  • Resell Services without written consent

5. Payment Terms

Services are billed monthly in USD. Payment is due upon invoice issuance. If payment is not received within 7 days, Services may be suspended. After 30 days outstanding, we may terminate and delete Content with 14 days' notice.

You are responsible for applicable taxes. Disputed charges must be reported within 60 days.

6. Data, Content, and Backups

You retain ownership of your Content. You are solely responsible for maintaining backups. JasCloud is not liable for loss of Content from any cause including hardware failure, software bugs, or security breaches.

7. Privacy and Data Protection

Our Privacy Policy is incorporated by reference. We comply with the California Consumer Privacy Act (CCPA/CPRA). You are responsible for ensuring your use complies with applicable data protection laws.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (a) JasCloud shall not be liable for indirect, incidental, special, consequential, or punitive damages; (b) total aggregate liability shall not exceed fees paid in the 12 months preceding the event; (c) these limitations do not exclude liability for gross negligence, willful misconduct, or fraud.

9. Indemnification

You agree to indemnify JasCloud against claims arising from your use of Services, your Content, violation of these Terms, or violation of any law or third-party rights.

10. Termination

You may terminate at any time via support@jas.vc. JasCloud may suspend or terminate for: breach of Terms, overdue payment, security risk, legal requirement, or 12 months of inactivity. Upon termination, Content is available for 14 days, then permanently deleted.

11. Disclaimer of Warranties

SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Governing Law

These Terms are governed by the laws of the State of California. Disputes shall first be submitted to good-faith negotiation. If unresolved within 30 days, either party may bring action in California state or federal courts.

13. Changes

Material changes will be communicated 30 days in advance. Continued use constitutes acceptance.
